Welcome to HostingBarn PTY LTD (https://hostingbarn.africa). These Terms of Service ("Agreement") govern your use of the products and services provided by HostingBarn ("Company," "we," "us," or "our"). By activating an account or using any of our services, you agree to be bound by these terms.

1. Acceptance of Services

By enrolling in any HostingBarn service, you agree to comply with all terms outlined herein. We reserve the right to amend these terms at any time. Continued use of the service after changes are posted constitutes your acceptance of the new terms.

2. Account Eligibility and Security

• Accuracy: You must provide accurate, current, and complete information during the registration process.

• Responsibility: You are solely responsible for all activity occurring under your account and for maintaining the confidentiality of your passwords.

• Security Breaches: You must notify HostingBarn immediately of any unauthorized use of your account or any other breach of security.

3. Acceptable Use Policy (AUP) - Anti-Abuse

To maintain the integrity of our network, the following activities are strictly prohibited:

• Spamming: Sending unsolicited bulk email (SPAM) is strictly forbidden. This includes "opt-out" lists and any mailing that results in IP blacklisting.

• Illegal Content: Hosting or linking to child sexual abuse material (CSAM), copyrighted material without permission, or defamatory content.

• Resource Abuse (Web/Email Hosting): Shared hosting accounts may not be used as a backup/storage repository. High-load scripts that degrade server performance for other users may be suspended without notice.

• Malicious Activity: Use of services for DDoS attacks, port scanning, IP spoofing, or hosting malware/phishing sites.

• Cryptocurrency Mining: Mining on VPS or shared hosting environments is strictly prohibited as it causes excessive CPU wear and resource exhaustion.

4. Email Services

• Sending Limits: To prevent IP blacklisting, shared hosting accounts are limited to 100 emails per hour.

• Storage: Email storage is subject to the disk quota of your specific plan.

• Blacklisting: If your actions result in our IP ranges being blacklisted, your account will be suspended, and a cleanup fee may be applied.

5. VPS (Virtual Private Server) Hosting

• Root Access: You are responsible for the security and management of your VPS. HostingBarn is not responsible for data loss due to misconfiguration or lack of security patching by the user.

• Fair Use: While CPU and RAM are allocated, sustained 100% usage that impacts the hardware node may result in throttling.

• Backups: Unless explicitly purchased as a managed service, users are responsible for maintaining their own off-site backups.

6. Billing and Payments

• Currency: All transactions are processed in ZAR.

• Renewals: Services are billed in advance. Failure to pay by the due date will result in automated suspension.

• Cancellations: Cancellation requests must be submitted via the WHMCS Client Area at least 10 days before the next billing cycle.

• Refund Policy: 30-day money-back guarantee for hosting; No refunds for domain registrations or VPS licenses].

7. Suspension and Termination

HostingBarn reserves the right to suspend or terminate any account that violates these terms or for any reason deemed necessary to protect our network.

• Data Deletion: Terminated accounts (for non-payment or abuse) will have all data wiped from our systems after 90 days. HostingBarn is not liable for data loss following termination.

8. Limitation of Liability

HostingBarn provides services on an "as-is" and "as-available" basis. We do not guarantee 100% uptime and shall not be held liable for any loss of data, loss of profits, or business interruption resulting from the use or inability to use our services.

9. Governance

These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of East London/Eastern Cape.

9. POPIA

By clicking 'Accept' or continuing to use our Services, you acknowledge that you have read, understood, and agree to be bound by our Terms of Service and our Privacy Policy, available at https://hostingbarn.africa/index.php/knowledgebase/3/Privacy-Policy.html. You specifically consent to the processing of your personal information as outlined in our Privacy Policy in accordance with the Protection of Personal Information Act (POPIA).
